1. Introduction & Sacred Intent
Welcome to Shivaya Rudraksha ("we," "our," "us"). Our website, shivayarudraksha.com, is operated from Kathmandu, Nepal. We are dedicated to providing genuine, authentic Nepali-origin Rudraksha beads and facilitating traditional online puja services. By accessing and using our website, placing an order for products or services, you agree to be bound by these Terms and Conditions, which are framed with respect for the sacred nature of our offerings.
2. Definitions
- "Website" refers to shivayarudraksha.com.
- "Customer," "you," "your" refers to any user or purchaser.
- "Products" refers exclusively to genuine Rudraksha beads, malas, and jewelry sourced and authenticated from Nepal.
- "Services" refers to Online Puja and other spiritual services booked through the Website.
- "Order" refers to your request to purchase Products and/or Services.
3. Business Location & Jurisdiction
Shivaya Rudraksha is based in Kathmandu, Nepal. All transactions, agreements, and spiritual services are conducted under the laws of Nepal. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal.
4. Product Authenticity & Exclusivity
Nepali Origin Guarantee: We deal exclusively in 100% genuine Rudraksha beads of Nepali origin. Our beads are sourced directly from the forests and farms of Nepal and are authenticated by our experts.
Natural Variations: Rudraksha is a natural seed. Variations in size, shape, color, texture, mukhi (faces), and lignification are inherent and not considered defects. Product images are representative; the actual item will be a unique natural specimen.
5. Online Puja Services
- Nature of Service: Our Online Puja service involves our trained priests performing the requested ritual at a designated sacred space in Nepal on your behalf. You will receive the offered prasad and/or ritual items (where applicable) and a video/photographic record of the ceremony.
- Booking & Scheduling: Puja dates are scheduled based on mutual availability and astrological muhurta (if requested). A confirmed booking is subject to receipt of full payment.
- Your Participation: While the physical ritual is performed in Nepal, you are encouraged to pray simultaneously from your location to enhance spiritual connectivity.
- Intangible Service Acknowledgement: You understand that puja is a spiritual offering and its outcomes are subjective, influenced by faith and divine grace. We do not guarantee specific results, solutions to problems, or fulfillment of wishes.
6. Ordering, Payment & Fees
- Orders for Products and Services are confirmed only upon receipt of full payment.
- We accept payments through secure gateways. We do not store your financial data.
- Prices are listed in USD. They are subject to change but will not affect confirmed orders.
- Puja Fees: The fee covers the cost of materials, priestly services, arrangements, and digital delivery. It is not a commercial transaction for divine favor.
7. Shipping, Delivery & Puja Prasad
Products: We ship worldwide from Nepal. The customer is solely responsible for all import duties, taxes, and customs clearance fees in their country. Risk passes to the carrier upon dispatch.
Puja Deliverables: Digital deliverables will be sent via email. Physical prasad shipping follows the same terms as product shipping.
8. Returns, Refunds & Cancellations
Rudraksha Products:
Returns or exchanges are only accepted if the product received is materially different from its description or is damaged in transit. Claims must be made within 3 days of delivery with evidence. No returns are accepted for natural variations or after the bead has been worn/used in sadhana.
Online Puja Services:
As services are performed on a specific date and involve preparatory work, cancellations are not accepted once the puja materials have been procured or the priest's time has been booked. No refunds are provided after the puja has been performed.
9. Intellectual Property
All website content is our property. Ritual videos/photos are for personal use only and may not be reproduced or publicly distributed.
10. User Conduct
You are responsible for providing accurate personal details (name, gotra for puja, etc.) and ensuring lawful use of payment methods.
11. Disclaimer & Limitation of Liability
- Spiritual Disclaimer: Our Products/Services are články of faith. We explicitly disclaim any liability for life outcomes or unmet expectations.
- Financial Liability: To the maximum extent permitted by Nepali law, our total liability shall not exceed the value of the specific purchase.
12. Privacy
We collect data solely to process orders. Our detailed Privacy Policy is available separately.
13. Amendments
We reserve the right to update these Terms at any time. Revised versions will be posted on this page.
